Lawyers under Uganda Catholic Lawyer’s Society-UCLS want Peter Nyombi, the Attorney General suspended from Uganda Law Society for alleged disregard of the constitution and laws of Uganda.
The lawyers under their umbrella body, Uganda Catholic Lawyer’s Society-UCLS have petitioned Ruth Ssebatindira, the President Uganda Law Society to suspend Nyombi.
In a July 23 petition signed by Jude Mbabali, the President Uganda Catholic Lawyer’s Society-UCLS and his general secretary Richard Lumu, Nyombi is accused of failing to advise President Yoweri Museveni against reappointing Benjamin Odoki chief justice in breach of article 144 (1) (a) of the constitution after he had clocked 70years of age.
They also claim Nyombi was quoted in the media claiming that article 142 (2) of the constitution provides for the said reappointment well knowing that the said provision does not cater for the Chief Justice.
UCLS also faults the Attorney General of failing to advise Museveni against appointing General Aronda Nyakairima internal affairs Minister in a mini cabinet reshuffled announced on May 24, 2013 before he resigns from the army.
The petitioners also trash the 12 page letter Nyombi wrote to Rebecca Kadaga, the Speaker of Parliament condemning and castigating her for retaining the expelled NRM legislators saying it was meant to misguide and undermine the office of the speaker.
They argue that the conduct of the Nyombi shows his lack of minimum expertise on constitutional matters, which any reigning Attorney General must possess. The petitioners say these along with other remarks Nyombi has made before parliament and in the media have given them cause to call for his suspension from the Uganda Law Society.
“Therefore we humbly pray that an Extra ordinary General meeting be convened within two weeks to consider the issues raised herein with the view to suspend the Attorney General, failure of which we shall be forced to requisition for one as provided under the law” the petition reads in part.
Should the petitioners succeed. Nyombi will join the list of other lawyers previously suspended from the Uganda Law Society. They include former Attorney General Kiddu Makubuya, the Prime Minister Amama Mbabazi, the Inspector General of Police General Kale Kayihura, and General David Sejusa, the Former coordinator of intelligence services amongst others.
