Masaka High court has sentenced a man infected with HIV/AIDS to 12 years in prison for defilement.
Court presided over by Lady Justice Margaret Oumo Oguli heard that Katende Lawrence (31) a resident of Kisanje west, Bukulula Sub County in Kalungu district defiled an 11 year old girl on three different occasions and infected her with HIV/AIDS.
Prosecution led by Innocent Aleto revealed to court that the victim’s grandmother learned of the defilement on 14th-January, 2011. She became suspicious after her granddaughter, who usually returned late from the communal borehole, came home earlier.
Aleto added that the victim revealed to her grandmother how she always came late because Katende always took her to the house of a one Birimuye where he would have sexual intercourse with her.
Aleto added that the victim told her grandmother that Katende had sexual intercourse with her on three different occasions and then reported the matter at police.
Aleto asked court to give Katende a maximum sentence which is death since he was infected with HIV/AIDS and there are chances of the girl being infected too. During the time of examination by the doctor, the girl’s hymen was ruptured and at there were signs of penetration.
She added that the convict did not appear remorseful and need not to be in society therefore she prayed to court to give him a long custodial sentence.
However, defense led by Herbert Zikusooka asked court for a lenient sentence because the suspect had already spent two years and 10 months on remand.
Zikusooka informed court that Katende had five biological children to look after.
Justice Oguli however in her ruling, said that the fact that the convict pleaded not guilty and yet he committed the crime and he was infected with the virus, the maximum sentence is death.
But due to the time of two years and ten months, he needs to be pardoned since he has five children to take care of, court decided to sentence him to twelve years in jail.
