Masaka high court has sentenced a twenty year old man in jail for defiling an eight year old girl.
Court presided over by Justice Margaret Oumo Oguli heard that Dominico Ssimbwa, 20 a resident of Kabulasoke in Lwengo district defiled a girl who is under the age of 14 years.
Prosecution led by David Baxter Bakibinga convinced court that in January, 2011, the victim was from Kabulasoke trading Centre when she met Ssimbwa who dragged her to the bushes and had sexual intercourse with her.
Bakibinga adds that the victim eventually experienced pain, prompting her to narrate the ordeal which she had initially concealed for fear of being victimized. Her grandmother then reported the matter to local authorities who facilitated Ssimbwa’s trial
State prosecutors add upon examination, it was established that the victim had signs of penetration with a recently ruptured hymen and had sustained injuries as a result of the act.
Bakibinga pleaded for a maximum sentence for Ssimbwa on grounds that such a heartless person needs a long custodial sentence for the safety of children in the community.
However, defense lawyers led by Herbert Zikusooka asked court to give him a minimum sentence considering the period of 2years and 11 months he has spent on remand
Justice Oguli ruled that the fact that the victim was defiled and that the convict committed the crime, the offence committed needs a maximum sentence but due to his repentance, and the time spent on remand, court decided to sentence him to thirteen years in jail.
