The FCC has come under heavy fire from all quarters of the media, as well as the football clubs, after the embarrassing misinterpretation of their own laws.
FUFA docked 3 points from Artland K for using ineligible players and awarded Mutundwe Lions a 0-3 win by forfeiture though most analysts confirm the points. Kasule and Nsimbe were sent off in the game between VCC vs Artland K FC played on March 29, 2014 at Masindi Stadium and were, according to FUFA rules, supposed to be suspended for the games against The Saints and Mutundwe Lions.
The two players, were both fielded against Mutundwe Lions FC and the game ended 0-0. But the FCC upon receiving the referees match report, found Artland K guilty of flauting the rules and awarded the game to Mutundwe Lions 0-3 by forfeiture.
The points awarded to Mutundwe Lions puts them in the driving seat in the battle for the last play off slot in the quest for promotion to the FUFA Super League next season with SuperSport coverage and money which many say is being done as a favour to Mutundwe owner and FUFA President Moses Magogo.
With one eye on the law as a learnt footballer and administrator, Bazirengede who founded reputable Bazirengede and Co. advocates in Kampala, was one of the individuals who amended the FUFA Constitution a few years back, but that decision backfired as his club is being forced into near relegation.
The lawyer, however, raged at suggestion that the FUFA Big league which is divided into two groups; Rwenzori and Elgon could be sanctioned with league competition laws yet it was a ‘Mixed-Format Competition’ where participating teams are drawn into groups and group teams playing against each other on a league or mini-league basis with topping team(s) per group qualifying for a knock-out stage.
A furious Baziregende wrote: ‘I’ve combed the rules that you have sent and I can ably confirm that you are wrong on your decision you applied to take points from my club. These rules clearly show that they were manufactured overnight to plug up a false claim. You are also making a false declaration in your Article 42 which shows that these rules came into force in September 2013 although for the 2012/2013 season when Mr. Engineer techniques president was not the fufa president.
“Now you have taken from the team points to put it closer to relegation because you want to help Mutundwe to the FSL and put away all the people you think are threatening the helm. You have created vagueness , I would like to inform you that everything that is vague is illegal. You also have to read the Fifa standard statute.
The Artland owner also hit out at ‘baised officiation’ of Mutundwe’s rivals intended to ‘harm’ following his club conceding 13 dubious penalties in 16 games.
“I have conceded 13 dubious penalties in 16 games but I have not asked my players to walk off the pitch. The team has also played with less players in many of the games due to red cards.
“I wish to make it clear that so long as you still conduct yourself in this manner, it is not only the game that will surfer but also others who have caused this suffering.
“We will put this to the appeal s committee to test to its integrity but in case it fails to see reason we will have no option but to refer the matter to the appropriate authorities.
“You have to know that we are the game because Allah has given to us the chance to be there.
