Kitgum police is under the spot for releasing an HIV positive man accused of sodomizing a victim of the nodding disease under unclear circumstances.
The suspect has been identified as Michael Olanya, a resident of Awere Village in Okidi Parish in Kitgum district.
Luka Nyeko, the Kitgum LC V chairperson claims that Olanya sodomized his 13-year-old victim on April 12th, 2014. The family of the teenager filed a complaint at Okidi Police Post, which picked up the suspect but released him shortly after.
Luka says the family of the suspect brought the matter to his attention after Police released the perpetrator on bond. He says he won’t relent until justice is done to the nodding syndrome affected family.
Luka stormed Okidi Police Post on Tuesday evening to investigate under what circumstances the suspect was released but found Corporal Ojera George, the in charge of outpost transferred to Kitgum Matidi Police Post. He says a case of homosexuality was recorded.
Anthony Opwaa, the father of the survivor says he reported the matter to Police when his son had difficulties passing stool on April 13th.
Odongo Robert, the OC Okidi Police post says the suspect reported to Police on Tuesday with a hand written Police bond as opposed to the typed copy that Police uses. This he says caught his attention prompting him to ask the suspect to report back on April 26 while he peruse through the file.
Corporal Ojera George said that the case dragged on due to lack of transport to move him to town for onward prosecution. This is the first case, of a sexual offense against a male victim of the nodding disease in the district. According to the newly enacted anti homosexuality act, Olanya faces the offense of aggravated homosexuality.
Section 3 of the anti homosexuality says (1) A person commits the offence of aggravated homosexuality where the— (a) person against whom the offence is committed is below the age of eighteen years; (b) Offender is a person living with HIV.
It also provides that a person who commits the offence of aggravated homosexuality shall be liable, on conviction, to imprisonment for life. It also requires that the person undergoes medical examination to ascertain his/her HIV status.
