High Court in Masaka has sentenced a 35 year old man to 17 years in jail. “Ssalongo” John Kalega (35) was convicted of defiling and infecting a 14 year old girl with HIV/AIDS.
Court presided over by Justice Margaret Oumo Oguli heard that Kalega committed the offence on 16th-March, 2011 at around 7:30pm.
The crime took place in Bugoma village in Kalangala district. The victim was home alone with a younger sister because their mother had taken another child to hospital.
Prosecution led by David Bakibinga told court that Kalega raped the girl. The victim was able to identify her attacker by his voice during a struggle to free herself.
She made an alarm and reported the matter to her mother upon her return. Kalega was arrested shortly after and detained at Kalangala police post.
Bakibinga told court that the doctor’s report showed the minor had been assaulted and defiled. The doctor also concluded that Kalega was of sound mind and HIV/Positive.
Bakibinga prayed for a maximum sentence because of the damage inflicted on the victim.
However, defense presented by Herbert Zikusooka told the presiding judge that prosecution has failed to prove beyond reasonable doubt that the convict had committed the crime.
Justice Oguli however did not find interest in defense’s submission because the four witnesses’ prosecution presented before court proved beyond reasonable doubt that the convict had committed the offence.
Oguli added that Kalega had also infected the victim with HIV/AIDS and therefore sentenced him to 17 years in jail.
