Museveni has no Authority to close Makerere – Kanyeihamba

The Veteran Supreme Court Justice Prof. George W Kanyeihamba has accused President Museveni of flouting the university and other Tertiary Institutions Act to close Makerere University.

Kanyeihamba says that the president should have consulted with the University Council prior to the closure as provided for by section 26 of the university and other Tertiary Institutions Act.

“If there are any reasons to close the university, they are to be explained by the university council which is the supreme governing body of the university not the president” Kanyeihamba said before adding that;  “Museveni is like a grandfather looking at his grandchildren, but does not take executive decisions, only the parents can take executive decisions.”

Kanyeihamba asserted that the university council, whose powers were usurped, should reopen the university because it is the supreme governing body of Makerere University.

Kanyeihamba made the remarks while meeting Makerere University law students who visited his home in the city suburb of Buziga.

The students were seeking legal advice from him as they prepare to sue the president over closing the university.

On Nov 1st 2016, the president, pursuant to the powers vested in him by the Constitution and Section 26(2) of the Universities and Other Tertiary Institutions Act 2001 as amended, decided to close Makerere University with immediate effect.

This came on the heels of persistent strikes that affected the proper functioning of the university.
