Details have emerged as to why the Busoga Sugarcane Growers Association (BSGA) electoral Commission on Thursday 22nd April 2021, overturned its earlier decision on dismissing Owek.James Mukembo from the race for the association’s Chairman.
Mukembo threatened to seek legal redress after the Association’s EC headed by Samuel Kigwana cancelled his nomination on April 20th, 2021 over unspecified grounds.
However, on Thursday, shortly after Mukembo through his lawyers of Wasswa P Silas & Co. Advocates had given an ultimatum of 12 hours or else drag the Association to Court over unfair dismissal from the race, the latter overturned their decision and reinstated his candidature.
‘’That our client is a member of Busoga Sugarcane Growers Association Code No.40GM4735 and by virtue of Article 3(1) of the memorandum and articles of association of Busoga Sugarcane Growers Association. That Our Client is interested in becoming the chairperson of Busoga Sugarcane Growers Association in the forthcoming election for the year 2021-2024 and he was duly nominated on the 7th day of April 2021 as a candidate to run on that post’’, reads in part the notice.
The notice adds that to their client’s surprise, the association electoral commission chairperson without any law, authority, wrote a letter on the 20th day of April 2021 informing him that he was unsuccessful in the nomination without any reason and a fair hearing.
‘’The purpose of this communication is to demand that you recall your letter as dated above and restore our client amongst the candidates without fail. Take notice that failure to comply with the above notice within 12 hours from the time of receipt of this notice we have full instructions to institute legal proceedings against you personally and the association for acting ultra vires and defaming our client at your cost detriment and embarrassment’’, adds the notice.
Mukembo is reportedly taking a lead and will face Fred Batambuze ,Tibita Abu, among others in a fight for the Association Chairman.
Currently, BSGA headed by the Forum for Democratic Change (FDC)’s Isa Budhugu is grappling with casualness where farmers argue that challenges ranging from Permit exploitation, Poor cane price among others can only be solved by the new leadership.
Owek. Mukembo is a Youth Minister at Busoga Kingdom and former Jinja NRM youth chairperson. The highly connected youthful BSGA Contender confirmed to Red pepper on Thursday evening that he had been reinstated in the race, adding that he is standing for the interests of the farmers unlike other candidates who have been accused of using the association for personal gains.
