Kasese Defiler Jailed For 32 Years

High Court sitting in Kasese has sentenced a 22 year-old man to 32 years imprisonment after finding him guilty of defilement.

Court presided over by Justice Dan Akiiki Kiiza heard that on September 28, 2011 while at Kikonzo cell in Kasese Municipality, Rashid Kule was found red-handed defiling a four year-old girl whom he grabbed while on her way to school.

State prosecutor Noah Kumya asked court to sentence the convict to death in order to sound as a sturdy warning to other men and as well protect young girls from defilers.

However, through his lawyer Solom Orone of the Uganda Christian Lawyers Fraternity, Kule asked for a lenient sentence arguing that he is a young man who can still reform. But Justice Akiiki ruled that at the age of 22, the convict was supposed to protect the 4 year-old girl as a young sister.

In a related development, the same court sentenced a 28 year-old man David Baluku a resident of Mbulamasi village in Mahango sub-county to 30 years in jail for defiling a 9 year-old girl.

Court ruled as baseless claims by David Bwambale that he committed the act under the influence of mental illness resulting from fits. The judge said that fits and epilepsy is not a mental illness hence sentencing him to 30 years in jail.

The latest convicts bring the number to five men jailed over aggravated defilement since Justice Akiiki opened a special High Court session for Kasese last month.
