IMPUNITY! State House petitioned as Ngabo Academy boss defies M7, grabs key govt land in Kiruhura
A retired UPDF soldier at a rank of Captain is the latest former NRA bush war fighter to be involved in forceful takeover of government land.
Capt (Rtd) David Bashaija, the owner of Mbarara based Ngabo Academy Secondary School has been accused of grabbing one square mile of land off Sanga Stock Farm in Kiruhura District, western Uganda yet aware that this is a government farm being managed by the National Animal Genetic Resources Center and Data Bank (NAGRC&DB) under the Ministry of Agriculture, Animal Industry and Fisheries (MAAIF).
And to make matters worse he has started partitioning it and selling it off to those interested.
In a bid to stop this impunity, MAAIF has since petitioned State House Anti-Corruption Unit (SHACU) boss, Brig.Gen. Henry Isoke to bring his colleague to order by “investigating and prosecuting this matter in accordance with the provisions of the law” in a letter dated 13th February, 2024 and seen by this publication.
HOW DID WE REACH HERE
Available information indicates that in the 1990s, Bashaija forcefully occupied about one square mile of the Government farm and resisted several eviction attempts by the authorities at the time.
This culminated into a Presidential communication REF. PO/17 dated 20th, November 2000 directing the then Attorney General to investigate grabbing of part of Mbarara Stock Farm under NARO and part of Sanga Stock Farm under NAGRC&DB and thereafter cause immediate prosecution of Bashaija.
Museveni’s letter read:
“CAPT (Rtd) BASHAIJA OF MBARARA
It has been reported to me that the above mentioned, a resident of Mbarara district, has taken over Government land in that District as under:-
(1) Part of Mbarara Stock Farm
(2) Part of Government land at Sanga Research Station
This is to direct you to look into this and, if true, cause his immediate prosecution and action.”
A follow-on communication REF. MOS/AI/45 dated 24th, August 2006 was made by then Minister of State for Animal Industry to the Minister of State for Lands requesting the latter not to issue any land titles on government farms and ranches including the subject land without express clearance from MAAIF.
“The purpose of this communication is to request the Ministry of Lands to support the Ministry Agriculture, Animal Industry and Fisheries (MAAIF) to stop this practice. We request that no land survey or issuance of land titles is allowed for any of our land without our consent. The titles fraudulently acquired should be cancelled immediately. This will help us to carry out National Development Programs without due interference. The Ministry of Lands also ought to support our efforts to urgently acquire land titles for all our lands country wide. Your timely interventions and necessary actions are called for,” advised then Minister of State for Animal Industry Kwamirama K. Bright (Maj. Rtd).
BASHAIJA NOT MOVED
Despite the above, Bashaija kept returning to the subject land and on Sunday,11th February, 2024 commenced grading and parceling out the subject land into plots for sale and has since erected a roadside land sale advert.
This explains why MAAIF is moving first to stop Bashaija’s impunity.
“As per the aforementioned directive from the Honorable Minister of Agriculture, Animal Industry and Fisheries, this is therefore to formally report this matter to your esteemed office and to request for your immediate action by investigating and prosecuting this matter in accordance with the provisions of the law,” concludes a petition to Gen.Isoke.
Bashaija could not be reached for a comment by press time but he has previously been quoted saying he bought the land under contention genuinely and can be vacated if compensated in billions.
WHY SANGA STOCK FARM MATTERS
According to MAAIF, the Government farm was established to among other things work as a livestock breeding and multiplication center for both highly productive and farmer preferred dairy and beef cattle which are accessed by farmers at subsidized prices.
“The farm also hosts a conservancy for indigenous Mubende and Kigezi goat breeds. Part of the farm hosts telecommunication masts for Kiruhura district while another part is set to host an Agricultural Technology University through a Presidential Initiative,” Gen.Isoke has been informed.
GOVT LAND UNDER THREAT
Some of the government land which was wrongly issued out to either Individuals or groups includes the 1 sq mile allegedly grabbed by Capt. Bashaija in Sanga, 30 acres given to Sanga Sub County – Kiruhura District, Nalukolongo workshop where some groups acquired titles including Government assets, and the land near Entebbe Airport 89. Ha to CAA.
MAAIF land which is under threat of giveaway or encroachment include Sanga Field Station, Kiruhura district measuring 640 ha; Kasolwe Stock Farm in Kamuli district measuring 800 ha; Ruhengyere Ranch in Kiruhura district measuring 5,1663 ha; Nshaara Dairy Cross Breeding ranch in Kiruhura district measuring 7,000 ha; Njeru Stock Farm in Mukono district measuring 720 acres; Rubona Stock Farm in Kabarole district measuring 736 acres; Maruzi Ranch in Apac district measuring 64 sq miles; Livestock Experimental Station in Wakiso district measuring 89.6 ha; Acholi Ranch in Kitugum / Acholi regions measuring 6,000 ha and as well Aswa Ranch in Kitugum / Acholi regions measuring 132 sq miles.
It remains to be seen how Gen Isoke will handle this matter given that his boss, President Museveni is tired and his hands are itching to crush all those who have stubbornly insisted on encroaching on government land, including national parks, game reserves, refugee settlement camps, wetlands, and forest reserves.
