Jolly Tumuhiirwe’s file has been forwarded from City Hall Court to Buganda Road Court this morning.
The former house maid Tumuhiirwe pleaded guilty to the charge of torturing a child Arnella Kamanzi she was supposed to care for on Monday in City Hall Court.
It was expected that today that the state prosecutor would brief the court on how Tumuhiirwe’s tortured the child before her sentence was read out.
However, State Prosecutor Mariam Njuki revealed to court that Tumuhiirwe’s file has now been transferred to Buganda Road Court.
Accordingly, trial magistrate Moses Nabende further remanded Tumuhiirwe to Luzira Prison until Tuesday, December 16 when she will be produced at Buganda Road Court.
Buganda Road Court is a higher court headed by the Chief Justice while the City Hall Court is headed by a grade one magistrate.
Tumuhiirwe’s lawyer Ladislaus Rwakufuzi explained afterwards that the City Hall Court did not have the mandate to try his client under the Anti-Torture Act and had listened to her case illegally.
Rwakafuzi further said that Tumuhiirwe’s guilty plea at the Buganda Road Court had been rendered null and void.
Tumuhiirwe will have to enter another plea when she is produced at Buganda Road Court.
