NRM Disciplinary Committee in Breach of Party Constitution – Rebel Mps’

Matters being entertained by the National Resistance Movement disciplinary committee are in breach of the party constitution.

This is according to letters written by rebel MP’s Theodore Ssekikubo MP Lwemiyaga County and Tinkasimire Barnabas of Buyaga West County through their lawyers after being summoned to appear before the committee on Tuesday.

The committee chaired by Al Haji Moses Kigongo also includes Wabudeya Beatrice and Lillian Oum both Presidential advisors and Makerere Chancellor Prof. Mondo Kagonyera.

Ssekikubo quotes the party constitution Rule 12 (f) which states that a disciplinary committee shall not entertain any matter before courts of judicature provided that determination of the case by the said courts does not preclude disciplinary action against a member of the NRM.

The Lwemiyaga County MP says the case is still before Court and they expected the party secretary general also senior counsel Prime Minister Amama Mbabazi to be aware of the matter.

He concludes that there is no goodwill of the secretary general and the committee to proceed but a personal vendetta hidden in the party.

Awaiting the MPs’ appearance before the committee this morning at Serena Hotel, Mbabazi confirmed receiving the letter from M/s Ochieng, Harimwomugasho and company advocates on behalf of Tinkasimire.

The letter was requesting for more time and particulars of the charges brought against Tinkasimire. Mbabazi says they had spent enough time considering the request and had given the MP up to 3:00pm to appear.

However, Mbabazi says if the MP’s decide not to appear, as they have, then the committee would to take new actions.
Others including Mohammed Nsereko Kampala Central MP and Wilfred Niwagaba MP Ndorwa County East had not responded to the summons.

The MP’s insist the matters they are being prosecuted for such as their stand on who should have the authority over and not a minister and their failure to support the national budget if health is not prioritized are important issues that affect Ugandans.

On Sunday 24th March the party released a press statement in the press inviting the MP’s to Serena Hotel at 10:00am Tuesday. Ssekikubo says they were not privileged to see the release since they were upcountry consulting on the marriage and Divorce Bill and there is little circulation of newspapers there.

The MPs lost their bid for a temporary Court injunction to block the disciplinary Committee from going on with proceedings against them.
In his ruling on Tuesday last week, High Court Registrar John Eudes Keitirima said that he sees no reason why the MPs cannot appear before the Committee.

He said that the rules under which to grant the injunction they sought from Court are clearly laid out and they did not convince the Court that they would suffer irreparable injury.

However, the MP’s have yet again filed another appeal before the High Court.
