LAND FRAUD! Majoline School boss Mukiibi arrested, in court tomorrow

The director of public prosecutions has ordered for the arrest and prosecution of Majoline College Mulawa proprietor for alleged land fraud.
Hezekiah Mukiibi, 75, a former employee of Uganda Electricity Board (UEB) is accused of grabbing more than seven acres of land and part of it is where Kira-Wakiso-Majoline College sits.
Mukiibi was eventually arrested by Kira Police and arraigned before Kira Court Chief Magistrate Roseline Nsenge on January 27.
He was charged with Forgery, Uttering false documents and procuring execution of documents by false pretenses C/C 353 PCA in relation to land title for plot 65,38,145,146 and 118 block 183 land comprised in Kyadondo, Kira municipality in Wakiso district.
He would later secure a cash bail of shs 1million and shs10m non cash for his two sureties. He will be back in court tomorrow, Thursday 9 over the same case.
THE CASE
According to court documents, around 1992, one Jack Kironde sold 5 acres of land to Fred Ntokore.
Ntoroke, in turn, sold the same 5 acres to Mukiibi who was then a surveyor.
The original seller, Kironde, proceeded to sign mutation forms and transfer forms in respect of the 5 acres in favour of names of second buyer Mukiibi having been introduced to him by Ntoroke as the person who bought the land.
That instead of processing the title for 5 acres, Mukiibi processed several titles of the same land measuring up to 7 acres.
However, Mukiibi insists that in 1998, he purchased 4 acres of land from Ntoroke and after paying for it, he went on to purchase more 3 acres and a sale agreement of 7 acres was executed.
That Ntoroke even signed for him transfer forms. And that is how he even proceeded to transfer the plots into the names of Marjorine School, being the founder. The matter ended at the police.
DPP WEIGHS IN
Before sanctioning the arrest and prosecution of Mukiibi, the DPP observed that the transfer of the said plots was directly from the name of Jack Kironde to Majorine School.
The DPP further noted that apart from the titles, there was no other evidence to support Mukiibi’s assertion that he bought the land in question.
“It appears to me that being a surveyor, the suspect [Mukiibi] tricked the vendor to sign the transfer forms and the vendor signed without knowing what he as signing given that he was an old man,” the DPP report reads and goes on to note that the handwriting expert report also showed that the signatures on the transfer forms in issue were not those of Kironde Jack.
“In the premises, the suspect [Mukiibi] should be charged with the following offences; Forgery, Uttering false documents and procuring execution of documents by false pretenses C/C 353 PCA.”
This is not the first time Mukiibi is involved in land fraud related issues as we shall report in our subsequent publications.
